By accessing or using SfumatoART, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the app.
SfumatoART is an art-practice tool that provides estimated paint colour matching, paint recipe suggestions, stocktake tools, teacher planning tools, AI-assisted art feedback, AI palette/project support, and related educational features.
The app is designed to assist users. It does not replace human judgment, professional teaching judgment, supplier verification, safety checks, legal advice, medical advice, psychological advice, counselling, or professional art assessment.
You must be at least 16 years old to create an account or use cloud-connected features unless a parent, guardian, school or authorised adult supervises your use. If you use the app on behalf of a school, organisation or class, you confirm that you have authority to do so and that you will comply with your organisation's privacy, child-safety, procurement and IT policies.

Colour matching and recipe results are estimates only. Results may vary because of lighting, camera quality, image compression, screen calibration, paint brand, pigment behaviour, surface, drying shift, varnish, brush technique, paint age, dilution, and environmental conditions.
Do not rely on the app as providing exact colour matches or guaranteed recipes.
AI features provide general educational and creative suggestions only. AI output may be incomplete, inaccurate, inconsistent or unsuitable for a particular user, class, artwork or purpose. You must review AI output before relying on it.
AI critique is not a professional art assessment, school grading tool, psychological assessment, therapy, counselling, medical advice or crisis service.
Teacher Mode, stocktake, class roster, shopping list, order tracking, lesson scheduling, delivery alerts and iCal export are planning aids only. Shopping lists, pricing, stock warnings, lesson readiness indicators and delivery warnings are estimates based on user-entered data and supplier snapshots.
Teachers and schools must verify quantities, prices, delivery times, safety requirements, student needs, curriculum requirements and procurement rules before relying on the app.
Do not enter identifiable student data unless you are legally authorised and your school, organisation, parent/guardian or relevant authority allows it. Where possible, use anonymous labels such as "Student 1", "Group A" or class-level quantities instead of names.
Do not upload photos of children, student artwork containing names, or sensitive student records unless you have the necessary permission and the upload is appropriate.
Any veterans, wellbeing or reflective art-practice content is general support content only. It is not mental health advice, medical advice, psychological treatment, therapy, counselling, diagnosis or crisis support.
If you or someone else may be at risk, contact emergency services or an appropriate crisis support service immediately.
The app may include supplier links, product references, price snapshots, and affiliate links. Prices, product availability, shipping, delivery times and product details can change. You must verify all information directly with the supplier before purchasing. Affiliate links may result in a commission to the app operator at no additional cost to you.
You retain ownership of your artwork, images, notes, palettes, stocktake records and other content. You grant the app operator a limited permission to process content only as necessary to provide the features you use, operate the app, troubleshoot issues, improve safety and comply with law.
Do not upload content that infringes someone else's rights, includes confidential information you are not authorised to share, or includes personal information you are not authorised to provide.
Some app data may be stored locally on your device or browser. Local data can be lost if you clear browser data, delete the app, change devices, use private browsing, or if your device fails. You are responsible for exporting or backing up important data unless the app expressly provides a cloud backup feature.
If paid plans are introduced, fees, billing cycles and cancellation options will be shown before purchase. App Store purchases and subscriptions may be managed through Apple or another app marketplace. Nothing in these terms limits rights you may have under applicable consumer law.
Refund rights depend on the platform used to purchase and applicable consumer law. We do not exclude, restrict or modify any consumer guarantee, refund right or other right that cannot lawfully be excluded.

The app may be changed, suspended, updated or withdrawn. We aim to maintain useful access but do not guarantee uninterrupted, error-free or permanent availability.
To the maximum extent permitted by law, we are not liable for indirect, consequential, special or loss-of-profit damages arising from use of the app, including inaccurate colour matches, stocktake errors, supplier changes, AI output, user data entry errors, local data loss, or reliance on estimates.
This clause does not exclude, restrict or modify any guarantee, right, remedy or liability that cannot lawfully be excluded under the Australian Consumer Law or other applicable laws.
These terms are governed by the laws of Tasmania, Australia, unless another law applies mandatorily to your use. You submit to the non-exclusive jurisdiction of the courts of Tasmania and Australia.
